Terms of Use

The Terms of Use set out below, define the conditions that apply to each and every use that the Visitor (defined below) makes of the Ticket Service (defined below). You are advised to carefully read these Terms of Use so that you are aware which rights and obligations apply to the use of this service.

When you, the Visitor, use the Ticket Service you are buying a Ticket (defined below) from the Event Organizer (defined below). The Event Organizer is responsible for the Event (defined below). To enable you as a Visitor to order a Ticket, the Event Organizer uses the services of Stager (defined below) who provides a technical platform to the Event Organizer. Stager is not responsible for the Event and /or Ticket  and as such does not form part of the Agreement (defined below). The Terms of Use specify who is responsible for which part of the transaction. 


1. Definitions

The following words in these Terms of Use, have the meaning as set out below

a. Event: the public or private event organized by, or on behalf of the Event Organizer;

b. Event Organizer: the natural person or legal entity who produces and / or organizes an Event, is responsible for the Event and sells Tickets for entry to the Event;

c. Visitor: the natural person or legal entity who uses the Ticket Service in any way whatsoever;

d. Terms of Use: the Terms of Use for the Ticket Service;

e. Location: the place where the Event takes place;

f. Agreement: the agreement between the Visitor and the Event Organizer;

g. Stager: the private company with limited liability Stager B.V., established and having its registered office in (3032 CM) Rotterdam at Zomerhofstraat 82, the Netherlands, registered under number 55142648 at the Chamber of Commerce and VAT number NL851582953B01;

h. Ticket(s): the admission ticket of an Event organized by or on behalf of the Event Organizer or products and services related to the Event, that is offered to Visitors by means of the Ticket Service used by the Event Organizer;

i. Ticket Service: the service of Stager that allows Visitors to order and / or to reserve Tickets from the Event Organizer;


2. Applicable Terms of Use

a. These Terms of Use apply to any use that Visitor makes from the Ticket Service.


3. Use of the Ticket Service

a. In offering and selling Tickets, Stager acts as a mediator in the realization of the Agreement between the Visitor and the Event Organizer. Stager expressly does not form part of the Agreement that is effected through the purchase of a Ticket. The Agreement comes into being after the Visitor has purchased one or more Tickets via Stager. Stager will provide the Tickets for the relevant Event on behalf of the Event Organizer. These Terms of use therefore apply solely to the use of the Ticket Service.

b. If the Visitor wants to buy a ticket, he / she must go through the procedure as set out by the Ticket Service. In that context, the Visitor must provide certain necessary information. The Visitor guarantees that the information provided is correct and up-to-date.

c. Visitor will receive confirmation via email once the payment has been completed. The Tickets will be offered as a download at a time to be set by the Event Organizer prior to the Event.

d. The Visitor must go through the procedure within the timeframe set for that purpose. If the procedure is not completed in time, no Ticket will be issued and any payments that may have been made will be reversed.

e. The Visitor is responsible for reserving and confirming the correct tickets. 

f. Event Organizer, and by extension Stager, reserves the right at all times to refuse Visitors to sell a Ticket.

g. In case of technical problems and / or malfunctions with the use of the Ticket Service, the Visitor can contact Stager via support@stager.co.

h. The General Terms and Conditions of the Event Organizer of the relevant Event and the General Terms and Conditions of the custodian of the Location apply to the use of Tickets and / or access to the Location. These General Terms and Conditions can usually be found on the website of the Event Organizer and the custodian of the Location or can be requested from the Event Organizer and the custodian of the Location. The Visitor accepts the applicability of these General Terms and Conditions.

i. Event organizer notifies Visitor of the fact that the Agreement established through the Ticket service concerns leisure activities as referred to in article 6:230p sub e Dutch Civil Code. As a consequence, Visitor does not have the right to rescind the Agreement without giving reasons as included in article 6:230o Dutch Civil Code. If, and to the extent that the Event takes place within 14 days after the conclusion of the Agreement, the Visitor, in conformity with article 6:230p sub d BW, agrees to this in advance and the Visitor herewith waives its right to rescind the Agreement after the Event has taken place.


4. Prices and payment

a. The Event Organizer sells Tickets via Stager. All prices as stated in the Ticket Service are in euros including VAT, unless expressly stated otherwise. Prices mentioned may be changed without prior notice. The price shown in the order overview during the ordering process is binding.


5. Refunds and cancellation

a. Tickets are non-refundable and non-exchangeable unless stated otherwise in the refund and cancellation policy of the Event Organizer or in the case of an event cancellation by the Event Organizer. 

b. When the refund and cancellation policy of the Event Organizer allows refunds or exchanges, the Visitor shall contact the Event Organizer.

c. If an Event is cancelled, it is the responsibility of the Event Organizer to provide the refund of Tickets. When the Event Organizer does not provide a refund or does not answer questions posed by the Visitor, the Visitor should contact Stager directly at support@stager.co to assist in obtaining the refund.


6. Prohibition of (re)sale for commercial purposes

a. Tickets are exclusively intended to be purchased by the Visitor for his personal use. Personal use means not with the intention to offer the Ticket up for sale or to (re)sell to third parties or to make them available for commercial purposes. Personal use does mean the purchase of Ticket(s) for the benefit of the group of people accompanying the Visitor to the Event. Personal use also includes the purchase of Ticket(s) as a gift. 

b. Visitor will only be entitled to (re)sell Tickets if the Tickets were purchased for his personal use, and circumstances preventing the Visitor to visit the Event occur afterwards, or if one or more persons from the group of people accompanying the Visitor to the Event is/are unable to attend. 

c. (Re)sale of Tickets as meant in paragraph b of this article is only allowed at a selling price that is no more than 20% in excess of the price the Visitor paid to purchase the Ticket. 

d. Visitor is not entitled to advertise in any way or to generate any (other) form of publicity in relation to the Event and/or part thereof if this is done with the intention of (re)selling the Ticket for commercial purposes. 

e. Visitor is not entitled to put his Ticket at the disposal of third parties, unless he does this not within the framework of commercial purposes and he makes sure to guarantee his obligations as phrased in these Terms of Use or the General Terms and Conditions of the Event Organizer, including the prohibition of (re)sale for commercial purposes, which shall also apply to the person receiving the Ticket and he shall guarantee towards the Event Organizer that this/these person(s) shall comply with these obligations. 

f. The opinion of the Event Organizer that the intention is aimed at (re)sale for commercial purposes is binding. 

g. In the event that a Visitor is in breach of one or more of his obligations as phrased in the above paragraphs of this article, Visitor will be liable to pay a penalty immediately due and payable of €10,000 per violation (per Ticket) and a penalty of €5,000 for each day that he continues to be in breach, notwithstanding the Event Organizer’s right to furthermore claim performance and/or (instead of the penalty) compensation of the damage suffered or to be suffered. 

h. Any Ticket that has been/is being resold for commercial purposes and/or is used for commercial purposes, can be invalidated by the Event Organizer. An invalidated Ticket does not give the right to access the Event, nor will the Visitor and/or the holder of the Ticket be entitled to restitution and/or compensation. 

i. In the event that the General Terms and Conditions of the Event Organizer also include a provision on the prohibition of (re)sale for commercial purposes, that provision will prevail over this one. 


7. Intellectual and trade property rights

a. The trade and intellectual property rights relating to the Ticket Service, including the intellectual property rights to texts, images, design, photographs, software and audiovisual material belong to Stager or its licensor and / or the Event Organizer. The Visitor will refrain from any conduct that could harm the rights or other interests of Stager or its licensor and / or the Event Organizer.

b. The use of the Ticket Service does not extend to the transfer of any intellectual property right of Stager, its licensor and / or the Event Organizer to the Visitor.


8. Privacy Policy

a. The Visitor is deemed to have taken note of the Event Organizer's privacy statement which should be consulted on the Event Organizer's website and to consent to the processing of the personal data provided by the Visitor.


9. Guarantees and indemnity

a. The Visitor guarantees that when using the Ticket Service he / she will refrain from using robots, spiders and scrapers, or other applications which in any way engender other actions than those for which the Ticket Service was intended. The Visitor furthermore guarantees that he / she will not use any applications that monitor and / or copy the Ticket Service or hinder or cause damage to the Ticket Service.

b. The Visitor indemnifies the Event Organizer and Stager for all third-party claims related to unlawful conduct by the Visitor.


10. Liability

a. Stager can not be considered as the organizer (Event Organizer) of the Event and is not responsible for and does not guarantee the (artistic) quality and content of the Event and circumstances during, or round, the Event. Stager does not accept any liability on this count.

b. The information about Tickets and Events, such as dates, changes and cancellations of Events, or the prices or availability of Tickets, comes from the Event Organizer. It is the Visitor's responsibility to check whether an Event has been cancelled or has been postponed and what the new time or location will be.

c. Neither Stager nor the Event Organizer guarantee that the Ticket Service is accessible at all times and without interruptions or malfunctions. Stager and/or the Event Organizer are in no way responsible for and/or liable to pay damages to the Visitor for any loss or damage resulting from the (temporary) unavailability or (interim) malfunction of the Ticket Service.

d. The Visitor indemnifies Stager and/or the Event Organizer from any obligation towards Stager and/or the Event Organizer for all third-party claims related to the non-compliance or insufficient compliance by the Visitor; whether or not arising from the Terms of use and / or any other rights of third parties.

e. Neither Stager nor the Event Organizer accepts liability whatsoever for loss or damage to Tickets by the Visitor for any reason whatsoever. From the moment the Ticket is made available to the Visitor, the risk of loss, theft, damage or misuse of the Ticket therefore lies with the Visitor. In the case of loss or theft, the Visitor can not claim a replacement Ticket or refund of any money.


11. Force majeure

a. Force majeure here means any shortcoming that can not be attributed to either the Event Organizer or Stager, describing a shortcoming that is not due to his / her fault and not described under the law or a legal act, or generally accepted current opinion including; decisions and / or measures taken by the government, international conflicts, violent or armed actions, labour unrest, natural disasters, exclusions and boycotts, fire, and disruptions in energy supplies, communication links or in equipment or software.

b. The Event Organizer and/or Stager is not liable for (consequential) damage resulting from force majeure.


12. Applicable law and competent courts

a. Only Dutch law applies to the Terms of use and the use of the Ticket Service.

b. All disputes between the Visitor (as a consumer), and the Event Organizer will be submitted to the competent court in the district of the Visitor's domicile, unless mandatory law decrees, or provides otherwise. In the event of disputes between a Visitor being a legal entity, and an Event Organizer, these will be submitted to the competent court in the district of the location of the Event Organizer.


13. Miscellaneous

a. Communications by electronic means are deemed to have been received on the day of sending of the electronic communication, unless the contrary is proven by the recipient. If the message is not received as a result of delivery and/or accessibility problems relating to the Visitor's e-mail box, this is at all times at the Visitor's risk.

b. If one or more of the provisions of this Terms of use is null and void or is nullified, the other provisions of this Terms of use remain in full force. The Event Organizer and/or Stager shall replace the relevant provision by a new, comparable provision.

c. The Event Organizer and/or Stager is at all times entitled, without prior notice, to make procedural and/or technical changes and/or improvements to the Ticket Service.

d. The Event Organizer and/or Stager reserves the right to (temporarily) decommission the Ticket Service and / or limit its use without prior notice and without incurring liability to the Visitor.
